If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?

Using H1B visa, the person has worked in US for first 3 years. Now the person has applied for H1B extension and still the petition papers have not yet come. After applying extension the person has gone back to India. The person's current company is hesitating to send him back to US.
Question
After getting the petition papers, can one transfer H1B visa to a different company staying in india itself and them come to US via new comapany?

Online status says my applications were recd on Oct 2/ 2007.
My reciept notices show the right date in August.
Is there any need to worry or notify any one about this?

Hi,
I had submitted my I-140, I485 and my wife's I-485/I-131/I-765 together. USCIS accepted everything but the I-131 form, which they returned saying that they couldn't located the I-485 application. Now, I have the receipt number for I-485. If I send I-131 back now, can I still use the old check? The old check is endorsed but was not deposited (they returned it).
To think of it, it is not my fault that they couldn't find the I-485 though it was in the same application packet.
I will appreciate any insight.

Hi,
I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. I see lot of excitement about asking USCIS about filing for I-485
even when visa numbers are unavailable. I am afraid this may
not work.
The ombudsman report 2005 was very critical about temporary EADs being issued to "potential terrorists" without proper background check. Filing for I-485 and getting EAD is like a limbo state btween GC and H1B. This approach may not gain much support.
(1) How about proposing that they should do FBI name check with I-140?
This is the petition for immigrant visa.
(2) Those who have approved I-140 but haven't filed for I485 due to
retrogression can apply for FBI name check separately.
(3) These added "security measures" will boost our chances of getting them OK to file for I-485 even when PD is not current.
p.s
the argument that FBI name check is valid only for a breif period is stupid, but it may be forthcoming. The response is what if some one commits terrorism 6 months after getting GC:D

Since everything is current now, and happy as I am, it jumped quicker on me than i anticipated. I am in precarious position to apply I-485 right away or see it get retrogressed again.
My dilemma is that I am unmarried and want to get married to someone in India, but also take my time selecting my mate.
My question is if I apply for I-485 in july or august, how much time do I have to get married in India and still make my spouse eligible for green card with me.

Regarding the receipt notice of I-485: which is the difference between the receipt date, receipt number and receipt notice.....from my understanding....the receipt date is when your I-485 application hits Uscis and the receipt notice is when the Uscis is really opening your package and looking at it?
Is it safe to travel( with valid H1b) knowing that your file hits the Uscis...or you have to wait for the receipt notice( now with so many filers for July, is it true that Uscis will send the receipt notice very late, maybe months, I mean later than the June filers.)?
Is it safe to travel after you file for I-485 and before getting the receipt notice....hoping that the receipt will come after you returned to U.S?

An I-140 petition filed for you by your current employer will have no impact on the pending I-140 appeal filed by your future employer.
