I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. part of the reason is that IV is originally indian club. we got the message but kind of lack the close organization.

Nevertheless, Indians do seem to be in the majority from those who are severely affected by legal immigration issues and are active. IV's membership demographics reflects that.
If you have any thoughts on how to encourage more folks from your community or other non-Indians to participate please feel free to share here or PM me.

Earlier today I got an email from USCIS that said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On June 29, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."
Then by the evening my I-485 said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Notice mailed welcoming the new permanent resident.
On June 30, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. My last and final update to this post. I got my original Green Card (Cards not green color) It was the happiest day, the wait was finally over the air smelled a little better.
My two cents - Have patience explore other means of getting green card if one doesn't work. An attorney once told me there are soo many ways and regulationsto get green card that half of them are not even in law manuals only the old timers know about them. Enjoy life life with green card and with out it is the same.but the time you spend never comes back. If you have problems with your employer just imagine if you didn't have a job. So make the best of your time and enjoy this great land which we call america.

Sorry eastindia but you are plain wrong. The US is not East India Company.
Here are the facts about the US checks and balances:
1. No single entity - not the President, Senate, House of Representatives, state Governors, nor anyone else - has the power to overturn a US Supreme Court ruling. Supreme Court decisions cannot be nullified by other parts of government.
2. If the Supreme Court strikes down a federal law, Congress can always modify the law until it is such that the Supreme Court does not consider it to violate the U.S. Constitution. Then they would have to vote to pass the new law, and the President would sign it.
3. The Supreme court can overrule its own rulings.
4. Congress can rewrite a law to conform with Constitutional standards.
5. The Constitution can be amended. This would require a two-thirds vote of both houses of Congress, and ratification by three-quarters of the states (actually, at least 39).
If you think a law is unconstitutional then it can be challenged in the court. For example, there was an article in WSJ about some lawyers planning to challenge the health care bill once it becomes a law. One of the reasons: the health care law would require a person to buy health insurance, which infringes upon constitutionally guaranteed individual right of freedom. Now not to deflect from the topic of this thread, the bottomline is if you think the law is unconstitutional then you can challenge the law in the court.
The Key Point: Equal opportunity employement advancement is protected by Constitution ("Title VII of the Civil Rights Act of 1964 (Title VII)")and hence the Supreme Court can overturn the per country quota limitation if the Supreme Court finds that the per country quota leads to discrimination at employment, which is unconstitutional.

Look beyond the marketing of lawyers and see their skills, track record and genuine concern for your long wait. You are asking the same lawyers to help you whose bread and butter comes because you are applicants in a long line.

Sure there may still be 2002 files waiting but it is definately not a GREAT number. Here are three logical bullets to conslude that.
- Many people with 2000/1/2 dates have already left USA - Tired: Could not
take the delay:Found good oppertunity back home or elsewhere
- Black labor market played a part to shift a considerable load either to EB2 or
PD date from 1999/2000 and thus many people preferred that path either
stuck in EB2 or have already got their GC
The only thing we can be unsure about stuck in NC with those early PDs.
Having said this, it is ofcourse impossible to predict perfect chain of future flow, I see hope for EB3-I in this year, particularly last quarter at least for the people having 2004-Mid and before PDs.

Why does Australian govt allow H4 Visa holders to work unlike the US Govt does??????
Doesn't AU government know that H4 visa holders don't necessarily have the same skills as the H1 holders do? May be in AU, there is no provision to change from H4 to H1. In the US, you can always change from H4 to H1, if you want to work. In the US, every visa is different. You just need to get the right visa according to your needs.
I hope this helps people who don't know that H4 to H1 is possible.

I am self filing I-131. I have couple of questions. Can anyone help me with these?
I am a July 2007 filer. I paid the old I485 fee (and biometric fee). I understand now I have to pay $305. But the instructions also say I need to pay $80 biometric fee. My fingerprints were done in 2007. I do not see anywhere in I-131 instructions that says 'Biometric fee is not required if fingerprints were done already or may be I overlooked it', but it seems someone posted in this thread, bio metric fee is not required.
My question is do I pay $80 now or not?
My second question is on "Class of Admission".
My last entry to US was on H1-B. Now I am working on EAD. What would I write in this box? H1-B or EAD or "Pending 485" or "Advance Parole". I was thinking it is H1-B, but wanted to make sure as I do not want to take any chances...?

Its very disappointing to me. My some of friends who filed labor just 2 months before me now will go citizenship for next year.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases. I believe when both center starts processing July cases then you can see significant movement in EB3 cases. I think you need to wait till September when new quota comes. Till that time as my Atorney says focus and save your Jobs. Get more skill. Without good job all above is meaning less. Busy yourself in NFL, NBA, NHL or Cricket be cool and calm. Nothing is in your hand except waiting.

I called Rep Lamar Smith office. The lady who picked up the phone asked me we are getting lot of calls. She asked me are you in supprot of the bill? I told her yes. I also told her that I am having master's degree from USA. My children are top student but may not get admission in some of NJ medical college just because we did not get GC since last 7 years. So we need help from Rep Lamar Smith to make USA more competitive. She also wanted to know that from where I was calling.
