Good you are in your late 20's. I am in my early 30's. Even 1-2 years makes huge difference for this GC. If I had the qualities of Gandhi, I would have not been here in this forum. Dont forget to call him as MAHATHMA Gandhi. I dont think there is even one MAHATHMA's here. All here are poor ATHMA's. Humans are great in adapting to any given situation. If a guy foresees that he cannot survive without knowing swimming, he will somehow learn that otherwise he is going to die. On other hand, the best swimmer in the world also cannot afford to swim for years just because he knows swimming. If you drop him in ocean with others, may be he will survive for longer time but he will seek for a life jacket or rescue sometime or later.
My whole point is everyone starts with optimistic approach when he starts. Show me one person who lands in US with pessimistic approach. You, me and all of our friends landed here with great vision for our life and career. The situation, surroundings, family issues, other personel issues drag him little by little to pessimistic way when he does not reach his set goals in time and instead stinks in the same spot having the required qualities to further his/her career and family.
A question for you: I know you will get married if you are not now and may have one kid at least at age 35. What will you be doing if you are here then without filing for 485. Will you have the same LEVEL of optimistic thinking? Answer honestly.
I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in..:rolleyes: Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

oh well..I jsut called Congressman's office...she took the place where I am from...she said she wasnt sure what his stand is when I asked her about those bills...
She saod she will pass on the mess age...and she knew I Was calling about the bills when I asked her to tx to someone who handles immi. bills and she said she could help me with that...she was polite..

Don't take me the wrong way, these guys sure are very nice, but just because he filed in July without a receipt does NOT mean anything. It's not like his 485 has been approved, and even if it had, that doesn't mean anything either.
Remember we are dealing with some contractors in the mail room, and without official guidance from USCIS in the form of a field notice, each employee in the mail room could make his arbitrary decisions.
So, i wouldn't delude myself based on what someone in IV core has done. It MAY sound logical to include the copy of 140 but then as you probably know by know, logic does not apply here :D

Asking the question is never the problem, it may make people uncomfortable but I want people (like yourself) who are contributing to at least ask IV before ranting on people like me (who dont contribute) to support the cause...Supporting the cause is NOT equal to giving IV money. The republicans already tried something similar ..."If you are anti-war, you dont support the troops"..That was fallacious and so are all the personal attacks on the "freeloaders" (like myself ofcourse).
this reminds me of a true story of a 5 year old kid who asked his grandma, why are you pouring somuch money building a wall around the empty site when you could have built a nice house. For him to understand and appreciate the necessity to spend money on the wall, he needs to understand numerous things. What can you tell such a kid. You'd smile and leave it at that. Sure he has a valid point about putting the money to a better use.

Hello,
I'm also in the same situation. My labor is approved May 2007. I'll need to apply for both 140 and 485 together. Can I do it at the same time ?? or do I need to file my 140 immediately and then 485 after a few days. Time is running out now, as we never know when USCIS would again stop accepting 485s. Please advice.

I agree with you there is no point in moving to canada if u are going to do the same job there. You might as well do it here.
The point is that if you move to canada or any other place you have the freedom to take a higher position and your spouse gets to work too. Thereby improving your income. I think these decisions are really based on personal circumstances. For some ppl it might be the right thing to do, for some it may not be.
Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.
For me, only person who could move to Canada is:
1. Way better career jump.
2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
3. Keep the GC processing alive in US.

Actually I made mistake in my math,
$20 (2% of $1000 monthly bill) * 2k ( 10% of 20k IV members) = 40K per month
I guess 10% people with $1000 monthly credit card bill is not too optimistic.. is it?
One simple way to measure this is, lets have poll. ( how do you create poll?) I have never done it before.

I don't know how many people know this, but I have worked with 3-4 different attorneys and I HIGHLY reccommend RAJIV S KHANNA.
Firstly, Rajiv reviews EACH & EVERY CASE!!!! - you find it hard to believe ? - no, its true, I spoke to the guy atleast 3-4 times. I had a question and i called the paralegal, she just heard me for 2 minutes and said, wait, I will get Rajiv on the phone and Voila - he spent like 45 minutes answering my every question.
I told him its a great relief to even talk to an attorney directly. Also, a little known fact is that apart from immigrationportal.com Rajiv has his own website for his clients, its a protected site and he answers every question himself, its not a complicated site like his portal, but real simple and nice. He does not overcharge, his staff worked weekend and nights to file my case. I was calling their office even on saturday at 8PM and have always been greeted with a smile and with extreme patience.
Every time i have left a message or sent an email, they have ALWAYS followed up, no matter what..it can't get better than this...
I have had horrible experiences with 2 other attorneys though..they even took my money and DID NOTHING..

Thanks for the clarification, Dixie. Your explanation that 'special rule labor certifications' mean that the candidate is the best person for the job, not minimally qualified, makes sense. Do you have a posted reference somewhere - a USCIS rule or DOL clarification - regarding this?

Yeah me too, in 2005 a company wanted to apply for me in EB3, though I was qualified for EB2. I didn't feel it was right to apply in EB3, unless you were a fresher.
I quit and joined an Wall street company in 2007, who finally applied in the right category

I can understand waiting for a year or 2. So you probably missed the July 2007 bus.
What can we all do to get out of this mess. We need some mass campaign addressing specific issues and an agile process where things happen every month. We need action.
