140 reached NSC on July 11.
Receipt date is July 17, attorney says they got it today, July 24.
So for those at NSC who filed within a day or two of me, mght be better to hold off for a couple of days before filing 485 with the colored sheet which will probably add some delays in the mailroom

H1b Transfer from IT to Marketing.

First THANKS to all for the fantastic information and help on this forum !
I have a H1 B based on IT ( Software Engineer).
I have already completed 6 years in the US, but I have three year extension till 2010 based on my labour pending for over 1 year.
I am not very keen about Green Card - But I wanted to change my job to Marketing for an insurance company (better pay and it is a role I like).
My questions are :
1) Can I transfer my H1 to do Markeing for the insurance company ( the job profiles are going to be different as my current job is in software) ?
2) Since I am on a three year extension based on my current Labor will it be an issue to transfer to the new company ? ( The new company is willing to transfer but is not willing to file a new H1).
Your advice is much appreciated.

Suppose I initially worked as an Engineer, and got labor and I-140 approved. Now, say I totally change my field to become a Business Development Manager, can I still port the older PD from the previous I-140 (assuming that a new labor and 140 will need to be filed for the new job) or does the job have to be same or similar for me to port the older PD?

though most part of Sch-A is doctors and Nurses it also covers under its Categorey II EXCEPTIONAL ABILITY PROFESSIONALS in ARTS AND SCIENCES. So some of the PhDs, Scientists and academics are also covered under Sch-A.
I think to oppose Sch-A s effort or H-1 B is counter productive to the IV's goal as both of these categorey include wide ranging support from Health as well as Tech Industry. More over Labor Department have already accepted by giving BALANKET APPROVAL TO SCH-A that THEY ARE THE SHORTAGE OCCUPATIONS. so there is established precedent for that.
We should focus more on PACE, SKILL or OTHER education or energy bills and try to accomodate over concerns and points in those rather than focusing on CIR, which is most likely to be in discussions only till PRESIDENT for 2009 take over his tenure. Good you are in your late 20's. I am in my early 30's. Even 1-2 years makes huge difference for this GC. If I had the qualities of Gandhi, I would have not been here in this forum. Dont forget to call him as MAHATHMA Gandhi. I dont think there is even one MAHATHMA's here. All here are poor ATHMA's. Humans are great in adapting to any given situation. If a guy foresees that he cannot survive without knowing swimming, he will somehow learn that otherwise he is going to die. On other hand, the best swimmer in the world also cannot afford to swim for years just because he knows swimming. If you drop him in ocean with others, may be he will survive for longer time but he will seek for a life jacket or rescue sometime or later.
My whole point is everyone starts with optimistic approach when he starts. Show me one person who lands in US with pessimistic approach. You, me and all of our friends landed here with great vision for our life and career. The situation, surroundings, family issues, other personel issues drag him little by little to pessimistic way when he does not reach his set goals in time and instead stinks in the same spot having the required qualities to further his/her career and family.
A question for you: I know you will get married if you are not now and may have one kid at least at age 35. What will you be doing if you are here then without filing for 485. Will you have the same LEVEL of optimistic thinking? Answer honestly.

Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.
I am not sure if another rally will help. I believe lobbing in DC, meetings with law makers will be more effective than rallying or trying to get public attention.
The rally that illegal immigrants made some time back had huge turnout and large media publicity - it was a success in that sense. But I think it was counter-productive for them. The fact that no pro-immigration bill had passed proves this.
I agree with the sense of urgency part. With the economy heading into recession and job market weakening, getting more skilled workers into the country will be the last thing congress will take up. So it is important to get something done sooner than later.

I started with a 20$ recurring contribution and now I contribute 100$. I am not going to wait for the Google Ads to show up on IV and I think every penny I contribute for IV is money well spent for a cause I believe in. At the end of the day I am helping myself and I am also with a group of 23,000. I belive together we can achieve our goals. Please come forward to contribute

I guess 10% people with $1000 monthly credit card bill is not too optimistic.. is it?

I cannot believe that after everything that's happened over the last year or so, out of how many thousands of members of this group - just 199 of us called??
What are we doing as a group of people? Is it such a wonder that this country isn't moving on our immigration woes when we ourselves won't pick up the phone and talk to somebody about our troubles?
Wow-talk about complete and total apathy....I'm ashamed on behalf of each and every one those people who think they'll let someone else solve their problems - in which case I hope they don't ever complain about their lot in life. They have no right to.

Just think about this there are a lot of anti's out there and they can and will vote. to offset that the volume of calls from us the non voters has to be substantially large. I called got my wife to call and a couple of friends I will try and talk to all my friends in TX to call as well. But that will just no cut it unless all of these 24000 so called members (I do not consider passive readers members.) will call and get all of their friends to call. I promise you when we get that level of participation whoever be the president, whomever hold the majority in House and / or senate our bills will be brought on the floor will be voted on, and will be signed by the president!!!
