I believe people in the SV have more sense of host, sense of responsibility, and sense of rights, as immigrants are majority here.
Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..

If the media holds Obama to the same standard as they do the republicans, you will see the democrats crumbling faster than a cookie.
There is so much hypocrisy in the media. If women vote for Sarah Palin it is wrong because you voting her just because of his gender. But oh, if you are black and dont vote Obama, then you are the most odious person living in this world. How will you explain your kids that you did not support a black person for presidency? This kind of duplicity is keeping Obama look good in the eyes of people. Throw off your goggles and you will see the same issues with Obama that you see with Sarah.
Also, so many low intensity criminals are asked to do community service, that does not qualify them to become the president of US. And what happened to his moral fiber when he changed his opposition to the telco immunity bill and voted so that he does not look bad on security issues? Lets just keep the Rep and Dem propaganda lines aside. You and me are non-citizens without a vote so we can afford to be on the sideline and have an impartial opinion. Now with that attitude think about the two contenders. I liked some aspects in both, McCain seemed like a great guy with a great story (POW et al) I liked the way he initially backed CIR even though most of his party men opposed it; I liked the way he started supporting Bush when everyone else in the world is hating him and gave the support for troop increase. But of late his campaign has become sleaziest...all lies. They took one vote of Obama out of context and say that his only contribution to education is sex education in KG. They showed Obama as the reason for increasing gas prices etc. Even I can see how idiotic these claims are and McCain is still supporting them. Then his whole equation with Bush - he is using his connections for fund raising and accepting his support but publicly acts as if he is running against Bush. This whole republican propaganda machine projecting Palin as next best thing in US politics is laughable. She does not have any experience and whatever little experience she has - she seems to have abused it. Well she does look good and seems to have fired up their cadre - that is good enough for them. Of all McCain's shortcomings - his choice of VP is most horrible - its a purely political choice. Nobody is complaining about women voting her (actually none of women's organizations vote her as her extreme right wing opinions) - the problem is republicans wants people to stop thinking about ISSUES and think who is reposible for this state and think about who is better to solve them - they just want people to think about pigs, lipstick, moose, sex, kindergarten, etc and vote enmasse to Palin (note they gave up on McCain already that is why this sensationalism on a VP).
Obama side - yes he is inexperienced (and infact I liked Hillary during primaries) but atleast he is running a very honorable campaign and convention. He is atleast talking about issues. The notion that journalists are light on him so .... over ... and so primary time theme. If there is a Palin like issue on him (say he is involved in firing someone; or exaggerating facts about her opposition to bridge to nowhere; or even about family with a teen-aged pregnant daughter) the press would have been on fire just like when Rev.Wright was an issue. So dont say that press is light on him. About the race - you may not see everything open in our offices but yes his race is a main reason why he is still backward in polls if Obama with same policies and same charisma and same experience level and background is a white guy he would have run away with this election already. Whether we like it or not race is a factor and it works both ways. The thing that I dont like about Obama is the fact that dems are still didnt close this thing - the state of economy, an illogical war, an all-time low popularity of incumbent president who belong to other party - still thing is not closed. I truly think that it would have been different if Hillary is the nominee.
About whether community organization is a reason enough to become president - on the same token we can ask - whether crashing your plane in a war is reason enough to become president. Ofcourse not - both of them have enough strengths to came to this point than being onetime organizer or onetime POW. As someone in the sidelines - I like them to see to run this campaign in a honoroble way and discuss real issues rather than rake up silly/idiotic/dumb/fake issues. Both initially seemed promise in running campaigns in that way but of late McCain/palin went off the line and its slowly becoming a mug-slinging match. In that respect I started liking Obama more.
On immigration related issues - especially EB related issues - I think none of them can make a difference. We need something to be done in congress and personally I think that probability of something happening next year is very low (that is why HR5882 is so important for us - its right time and if we miss it we have to wait for another couple years maybe).

Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!

(IMO, mcain is honest man and a well tested politican, dont want to comment about obama. dont want to get into the discussion about who is better. Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.

A friend of mine transferred his H1b from company A to company B. He applied for the H1b transfer and then started working on company B. His H1b from company A expired while his petition was pending with USCIS. He received an RFE after 3 months. Company B responded to RFE but received one more RFE for the previously responded RFE. Now my friend fears that his H1b transfer petition may be denied. Would it be possible for my friend to return to company A and apply for H1b under premium processing even though his H1b with this company expired couple of months back? He has been working all this while on the basis that his petition is still pending with USCIS. Any suggestions or advise would be much appreciated.
Legally you can start working for company B once you get the receipt.
think there is no limitation on number of H1's filed for one. so you can go back to company A for the H1 or go to a new company C for that matter.

The point is there are rules and they tend to favor certain applicants over others in the queue. More education generally does mean more skill. It does not always mean more pay, but this country has decided to use education and work experience as the criterion for EB category allocation.
How can you say all nations have an equal opportunity to immigrate to the USA. That is patently false and you know it. Now you can defend it and say it is the US right to set its rules the way it wishes, and I can respect that, but to say it is equal opportunity is wrong.
What I have said all along is that EB immigration is to redound to the benefit of US EMPLOYERS not you or me. That is why the rules were skewed so much in their favor. Now, we agree there has been some abuse in this system, by those this system was meant to help, however its purpose remains intact. The rest of the rules are secondary to this intent, but nevertheless important.
The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. I do undersatnd that these companies did not help you.. y don't u understand that we r not talking about u :) the statistics r these companies bring tens of thousands here every year from one country, yes on H1 or L1, not to sponsor them for greencards, but arriving here with a dual intent visa that allows for greencard application is not such a casual opportunity and that's what I'm telling you is rarely available to the equally qualified non-retrogressed folks. Once here, those thousands transfer to these small/mid size companies u mentioned and choose to stay and apply for greencards even though they know that with their huge numbers current rules will make their greencard journey longer..

Basically H1 is done for LCA which is to make sure that American worker is not is replaced for for the purpose of low wages. Such an attestation is not there in H4. They cannot deny the H4 unless documents are not clear. But H1 they can deny for other reasons. Basically to make H4 not able to work is also a kind of protection for american workers. But it is strange that l2 people can work but H4 cannot work. One cannot fight every law because more provision we ask more delay will be there. IF Skil bill is passed in current form most of people will get gc within 1 or 2 years.

I can see sammyb's frustration but there is something to be said for collective intelligence and opnion. If we start restricting access to the site we loose out on the "Wisdom of the Crowds". A good example is free file sharing websites that have very few people contributing (<10%) but the benefit to the community is huge and the membership becomes ever larger because it is free. So as IV becomes more popular (which should be are foremost goal) there will be more people willing to contribute (even though the percentage of people contributing might still be small). I am not making a case for free loaders, instead I am making a case for free access to information.
I salute Needhelp! for her commitment to this cause.
Why can't we move from a free service to a membership based and see how many people still continue ... evenif with 25K members it is only a handful who are active and part of the initiative ... so I would suggest to go for a membership ...

My 'Employer #2' H1B I-94 and 'Employer X' H1B I-94 numbers matches with I-94 number that I got at 'POE'.
Receipt Data is July-2006 for 'Employer X' H1B.

2. Last Date of entry in USA
3. Date when I-485 was filed
I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.
If beneficiary's initial H-1B was counted against cap in last 6 years, then subsequent H-1B petitions are not subject to cap and usually referred as H-1B transfers.

Receipt Data is July-2006 for 'Employer X' H1B.

1. I-797 dates for Employer 2 and X
2. Last Date of entry in USA
3. Date when I-485 was filed
I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.

I am on L1 Visa & I went to SSN office to apply SSN for my child (L-2 Visa). They refused to accept my application and they wanted Documentation from the appropriate government entity explaining the need for the SSN as per
