Hi,

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

What are the best options for H1B refiling case

in case if it is denied, will it super impose the original H1B approval ?

is it good idea to cancel/revoke pending H1B refiling case ?

Hi,

I have an approved labor, H1 Visa stamp still valid 2.5 years more. I will be applying for I140/485 once this debacle settles.

Can any one tell me, what are the consequences of leaving the US for a weeks vacation in India, while the application is in progress? Some say it is abandoning the application.....Would anyone know

Also, my wife is now on a B1. When I add her name to the 140/485 and she comes back as an H4, will it cause issues

My country of citizenship is Canada and currently working on TN status. Canada is covered under Visa waiver program so, I don't need to get visa stamping but need to travel through a POE so, I could get new I-94 for the H validity period.

In the I-129, I have opted for Calgary as POE, but due to some reasons now I have to travel via Toronto, would that be ok?

Bill Clinton was in Cisco Campus last week in connection with some strategic meeting for Cisco, which they have it yearly at Monterey, CA. Clinton has made it clear to its employees, they come first in line in respect to immigration/Green Cards. Rest follow. So it may be a good idea if followed up with Bill. He supports Tech Industry. Apparently, employees have access to this info via Video On Demand internally.

Bill Clinton was a special invitee at Cisco. Would it be a good idea to connect with Clinton to seek support ? Perhaps too late ? Vinod Khosla and Bill are extremely close.

MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.

What are the limitations in this path. Do we always have to be in USA on valid H1B.

Hi I just graduated last year as an accounting major. I recently got an offer for a Property Accountant position at a real estate company. So it's not a pulic accounting firm. I was wondering if I'm eligiable to apply for H1B without a CPA?

Here is my scenario...

1. Applied my first EAD thru some lawyer (hence G-28)
2. I am planning to renew it on "my own"

Can I renew EAD without Attroney help... I know the answer "YES" but the main question is... do I need to inform USCIS saying that I want to withdraw my lawyer's and hence G-28 which was filed along with my first EAD?

If anyone are sucessful, please help me...My question is not on how to self apply EAD..My question is whether we need to inform USCIS about G-28...

I need your help to come to a conclusion on my issue.

1) I am on L1-b now in USA and working on company A

2) company B filed me and H1B as consulate process(means i have to get
stamped to start working for them)

Recently company B filed me labor+ I-140 mentioning as future employment and they are planning to file I 485 also now(since we have current dates)

Now I am planning to quit company A for who i am working on L1 and want to go for stamping to join company B who will be filing 485 for me. I have plans to travel to canada for stamping on August last week (after 485 filing).

Do we have any issues to get the stamping for new company who filed my 485


any help is greatly appriciated.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

Dear Attorney,

I work for a non-profit State University (6+ years), and my supervisor is letting me work from Canada for a year or so. As my university HR needs to have an H1B permit to keep me on the payroll, my University's International Officer is willing to keep my permit valid and keep renewing it even beyond 6 years as my I-140 is approved. She says that I can also apply for an H1B visa in Canada and visit US whenever my supervisor asks me to do so.

Wondering if this is doable without violating the USCIS & LCA rules and regulations? Thanks.
