My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??

As the Visa Dates are current, I want to file my 485 on July1st. Can I file the 485 for my wife and son at a later date(because they are travelling to india on june 16th and will be back on September 1st) or Is it a must that all of three(myself,wife,son) should file for 485 at the same time.
Can I add their names to my 485 later.?
Currently My wife and son(6years old) are on h4.

I am US citizen since March 2009. Husband just received an interview notice for August 11 after having filed all required documents and application for I-485 adjustmnent of status. Along with other documents, we submitted a xerox copy of his I-94 which he overstayed. Unfortunately, he lost the original. My concern is, the interview notice states he is to bring the original I-94, which he no longer has. He can prove however the date of his last entry to the US, as he still has a stamp in his passport with admission date, a sticker on his passport cover for baggage and I can probably dig up his boarding pass. Again - we also made a xerox copy of both sides of I-94 when we still had it. What do I do? Should I get a duplicate? Or is the xerox enough for the interview? I would hate his application to be denied because of this. Please let me know if you had a similar experience or any advice on what I should do.

My wife was on same boat as many students. Her H-1B petition had an rfe. RFE was later denied and we still have MTR. This year she got her H-1B approved without RFE. We did specify in application about previous year rejection.
Bottom line is there are no easy trends to observe. Luck seems to play a big role than anything else. Obviously, all the documents must be in good shape.

The Reuters/Zogby Index, which measures the mood of the country, also fell from 98.8 to 96 -- the second consecutive month it has dropped. The number of Americans who believe the country is on the wrong track jumped four points to 66 percent.
Bush's job approval rating fell to 24 percent from last month's record low for a Zogby poll of 29 percent. A paltry 11 percent gave Congress a positive grade, tying last month's record low.
"There is a real question among Americans now about how relevant this government is to them," pollster John Zogby said. "They tell us they want action on health care, education, the war and immigration, but they don't believe they are going to get it."
The dismal assessment of the Republican president and the Democratic-controlled Congress follows another month of inconclusive political battles over a future path in Iraq and the recent Bush veto of an expansion of the program providing insurance for poor children.
The bleak mood could present problems for both parties heading into the November 2008 election campaign, Zogby said.
"Voter turnout could still be high next year, but the mood has turned against incumbents and into a 'throw the bums out' mindset," Zogby said.
The national telephone survey of 991 likely voters, conducted October 10 through October 14, found barely one-quarter of Americans, or 26 percent, believe the country is headed in the right direction.
The poll found declining confidence in U.S. economic and foreign policy. About 18 percent gave positive marks to foreign policy, down from 24 percent, and 26 percent rated economic policy positively, down from 30 percent.
A majority of Americans still rate their personal financial situation as excellent or good, although the number dipped slightly this month to 54 percent from 56 percent. In August, 59 percent rated their finances as excellent or good.
"Americans are still feeling good about a number of things in their lives, but not about the government's leadership," Zogby said. "They are giving up on this government."
The Index, which made its debut last month, combines responses to 10 questions on Americans' views about their leaders, the direction of the country and their future. Index polling began in July, and that month's results provide the benchmark score of 100.
A score above 100 indicates the public mood has improved since July. A score below 100 shows the mood has soured, and a falling score like the one recorded this month shows the nation's mood is getting worse.
The RZI is released the third Wednesday of each month.

Folks,
I have a question regarding travel while on AOS. We are on H1 and H4 (primary and dependent) but do not have the H1 and H4 visa stamps. Planning to use AP.
When we leave the country, do we need to drop the H1/H4 I-94 stubs from the current visa approval forms OR the I-94 stubs issued during last entry? Ofcourse the I-94 nums on current visa approval forms and on visas last entered are the same, but different visa statuses when last entered US.

As PERM processing becomes faster in recent months, icert problems continue though. DOL has reported that the incorrect error message that pops up upon entering a date for the prevailing wage source is the result of recent system edit. The glitch will not affect useability, i.e., users can bypass the error message and submit LCAs for processing. In addition, a fix is in development and will likely be in place today or tomorrow. Common recent problem is receiving an inappropriate system warning when entering the Prevailing Wage source. We hope these problem will be fixed soon as the PERM process becoming rather annoying. We will keep our readers posted.

I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can i get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean convert from H1 to B1 for multi year?

Applied for LCA before H - 1 B renewal and got the error "FEIN ID NOT FOUND " error. I submitted additional documents still waiting for reply from DOL. Applied for LCA on august 5 , got the reply "FEIN not found" on august 13, faxed additional documents on same day still did not hear back from DOL.. Pls advice how long it will take now???????

I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me
