Guys, Assuming that everyone from July Filers group went through FP for AOS once at that time, do they need to go again to get the AOS approved now? My question is ppl who r being approved these days and if they r july filers, did they go for 2nd FP? Can uscis use FP of EAD in 485 ?

I am one of the July 2007 EAD filers and did not file for AP at that time.
So I am in the process of the renewing EAD & Applying for AP for the first time.
I have couple of questions..
do you get Finger Printing for EAD Renewal ?
do you get Finger Printing / Biometrics for first time applying of AP [Advance Parole]
Your help is much appreciated

Having a pending EB1 I-140 does not in itself confer any status. If you filed an I-485 concurrently, then you are permitted to remain in the US pending adjudication. If you have a currently valid H-1B you may remain or renew pending adjudication.

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

I currently am on F1 Visa- OPT valid till June 2011.
My employer will file for H1 this April.
If my H1 is rejected for any reason, will I be eligible to work on F1 - OPT visa?

Hi,
I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.
Now i wanted to change my status from H1b to F1(CPT). My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?
I would really appreciate your help regarding this issue..

I need to know when can I fly back to US on my H4 visa(valid till 2011 ).
My husband has joined a new job and his H1 B transfer has been filed .
Do I have to wait for new I 797 or Can I just travel on my old H4 visa and
visa transfer receipt notice .( he is filing the H1 transfer by premium processing ) .
His new employer is suggesting me to reenter on old h4 and before my husband
joins their company .
But for me that will be very soon ( not fulfilling the purpose of my visit ).
Any help is much appreciated.:confused:

Hello
I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

I was in a similar situation and my lawyer advised to apply for H1 (come April) even without the H4 extension. A query will be sent asking to prove your status until atleast Sep 30th. You can then attach your H4 papers (assuming your H4 extn is approved by then).
Anyway, i am planning to apply for extension using premium processing just to make sure things progress smoothly.
